1. Scope
These terms apply to contracts for the sale and delivery of watches, accessories and other goods by Orfina-Swiss SA unless otherwise agreed in writing.
2. Offers and conclusion of contract
Offers, price lists and product information are non-binding unless expressly stated otherwise. A contract is concluded when ORFINA confirms the order in writing, issues an invoice or dispatches the goods.
3. Prices and payment
Agreed prices apply, generally in CHF. VAT is shown separately where due. Invoices are payable within the stated term without deduction. Default interest and reasonable reminder fees may be charged in case of late payment.
4. Delivery and availability
Delivery dates are estimates unless expressly confirmed in writing. Partial deliveries are permitted where reasonable. Events outside ORFINA’s control may extend delivery periods appropriately.
5. Shipping, benefit and risk
For collection, benefit and risk pass on handover. For shipping, they generally pass when the goods are handed to the carrier to the extent permitted by law. Obvious transport damage should be documented and reported promptly.
6. Inspection and defects
Goods must be inspected as soon as reasonably possible. Visible defects must be reported in writing within a reasonable period; hidden defects immediately after discovery.
7. Warranty
For justified defects reported in time, ORFINA may repair, replace or grant an appropriate price reduction. Damage caused by misuse, normal wear, external influence, third-party intervention or disregard of care instructions is excluded to the extent permitted by law.
8. Returns and exchanges
Returns or exchanges require an express agreement. Custom, personalised, specially sourced, worn or used items may be excluded where legally permissible.
9. Retention of title
Goods remain the property of Orfina-Swiss SA until paid in full where legally permissible.
10. Liability
ORFINA is liable for direct damage caused intentionally or by gross negligence. Liability for minor negligence and indirect or consequential damage is limited or excluded to the extent permitted by mandatory law.
11. Data protection
Personal data is processed under applicable data-protection law.
12. Amendments
The version in force when the relevant contract is concluded applies.
13. Governing law and jurisdiction
Swiss law applies, excluding conflict-of-law rules to the extent permitted. Jurisdiction is Solothurn-Lebern (SO), Switzerland, where legally permissible.
As of April 2026
1. Scope
These terms apply to inspection, servicing, overhaul, repair and other workshop services by SCW Schifferle & Schifferle GmbH unless otherwise agreed in writing.
2. Acceptance of service orders
Delivering or sending a watch or other object for inspection or repair constitutes an order within the agreed or reasonably apparent scope. SCW may decline work, in particular where repair is not feasible, the effort is disproportionate or ownership/authority is unclear.
3. Estimates and diagnosis
Estimates are generally non-binding and based on the condition visible during initial inspection. Additional defects may become apparent during work. Diagnostic, inspection or opening costs may remain payable even if the repair is not carried out where agreed or customary.
4. Performance of work
SCW performs services professionally. The scope depends on the order, technical condition and availability of suitable components. Removed or replaced parts remain with SCW unless otherwise agreed.
5. Completion times
Timings are estimates unless a binding date has been confirmed in writing. Technical difficulties, parts procurement, capacity constraints or force majeure may cause delays.
6. Prices and payment
Agreed prices are in CHF. VAT is shown separately where applicable. Invoices are payable within the stated period.
7. Shipping and risk
Items sent to SCW travel at the customer’s risk unless agreed otherwise. Appropriate packaging and insurance are the customer’s responsibility. After completion, risk passes on handover or on transfer to the carrier, as legally permitted.
8. Inspection on return
Completed work and returned items should be inspected promptly. Visible defects should be reported within a reasonable period and hidden defects immediately after discovery.
9. Warranty on service work
The warranty covers the professional execution of the work specifically commissioned and paid for. It does not cover unrelated defects, normal wear, pre-existing damage, material ageing, misuse, impact, moisture, magnetism, external influence or third-party intervention.
10. Old, worn or damaged watches
Hidden defects and material fatigue may only become visible when older or previously damaged watches are opened or dismantled. Liability for unavoidable consequences of pre-existing weaknesses is excluded to the extent permitted by law.
11. Water resistance
A water-resistance test refers only to the condition at the time and the test conditions used. It is not an unlimited guarantee. Ageing, impacts, temperature changes, misuse or later opening may impair resistance.
12. Uncollected items
Reasonable storage charges may be applied to items not collected or returned within a reasonable period after notice.
13. Liability
SCW is liable for direct damage caused intentionally or by gross negligence. Indirect and consequential damage is excluded to the extent permitted by law.
14. Data protection
Personal data is processed under applicable data-protection law.
15. Severability
If individual clauses are invalid, the remaining provisions remain in force.
16. Governing law and jurisdiction
Swiss law applies. Jurisdiction is Baden (AG), Switzerland, to the extent permitted by law.
